1. OVERVIEW AND AGREEMENT TO THESE TERMS

GlutenFree-Supermarket.com is operated by Authentic GF Foods (“Authentic GF Foods,” “we,” “us,” or “our”). Authentic GF Foods also operates the Authentic Foods brand.

These Terms of Service (“Terms”) govern your access to and use of GlutenFree-Supermarket.com, including our website, online store, content, features, products, and related services (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform through which we offer products for sale.

By accessing or using the Services or placing an order through GlutenFree-Supermarket.com, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy and Refund Policy.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms is intended to waive or limit any right or remedy that cannot lawfully be waived under applicable federal or state law, including applicable California consumer protection laws.

2. ELIGIBILITY AND ACCOUNTS

You must be legally capable of entering into a binding agreement to make a purchase through the Services.

If you create an account, you are responsible for:

  • providing accurate and current information;

  • maintaining the confidentiality of your login credentials; and

  • activity occurring through your account.

You may not use another person's account without authorization or transfer your account to another person without our permission.

  • limit quantities;

  • discontinue products; and

4. FOOD, INGREDIENT, ALLERGEN, AND DIETARY INFORMATION

Because we sell food products and baking ingredients, you should review the actual product package before consuming or using a product.

Ingredients, allergen statements, nutritional information, certifications, manufacturing information, and packaging may change.

If you have:

5. ORDERS

Submitting an order constitutes an offer to purchase the products included in the order.

An automated order confirmation confirms that we received your order; it does not necessarily constitute final acceptance of the order.

We may decline, cancel, or modify an order when reasonably necessary, including because of:

  • inventory or availability issues;

  • an obvious pricing or product-listing error;

  • suspected fraud or unauthorized payment activity;

  • payment authorization failure;

  • shipping restrictions;

  • regulatory requirements; or

  • other circumstances that prevent fulfillment.

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion of the order.

Once an order has entered processing or fulfillment, we may not be able to modify or cancel it.

Products may be purchased for personal, household, culinary, bakery, restaurant, foodservice, professional, or other lawful business purposes unless otherwise stated.

6. PRICES, TAXES, AND PAYMENT

Prices, discounts, promotions, and product availability may change without notice.

The applicable product price is generally the price displayed when the order is placed, subject to correction of obvious errors.

Applicable:

  • sales taxes;

  • shipping charges;

  • customs duties;

  • import charges; and

  • other legally applicable charges

may be added to the order where appropriate.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment processors to process the applicable charges.

We may use third-party payment processors. Payment information provided to those processors may be governed by their terms and privacy policies in addition to ours.

7. SHIPPING AND DELIVERY

We offer flat-rate standard shipping and generally select the shipping method we believe is most appropriate and efficient for the order.

Orders may be shipped through FedEx, USPS, or another appropriate carrier.

Carrier selection may depend on factors including:

  • destination;

  • shipment size and weight;

  • service availability;

  • transit time; and

  • shipping cost.

Expedited Shipping

Expedited shipping may be available for an additional charge.

Where available, you may select an expedited option during checkout.

We will advise you of available expedited shipping options and any additional charge.

Shipping Estimates

Shipping and delivery dates are estimates unless we expressly state otherwise.

We will use commercially reasonable efforts to ship orders within any shipping time represented at the time of purchase.

If we cannot ship an order within the time represented, or within the time otherwise required by applicable law, we may contact you regarding the delay and, where required, offer the option to consent to the delay or cancel the unshipped portion of the order for a refund.

Delivery may be delayed because of circumstances outside our reasonable control, including:

  • carrier delays;

  • severe weather;

  • natural disasters;

  • transportation disruptions;

  • holidays;

  • customs processing;

  • incorrect or incomplete delivery information;

  • labor interruptions; or

  • other events beyond our reasonable control.

We are not responsible for carrier delays after an order has been timely tendered to the carrier, except to the extent applicable law provides otherwise.

If an order arrives damaged, incomplete, incorrect, or otherwise materially affected during shipment, please contact us promptly so that we can investigate and provide an appropriate remedy where warranted.

8. RETURNS, REFUNDS, AND REPLACEMENTS

Returns, exchanges, refunds, and replacements are governed by our Refund Policy, which is incorporated into these Terms by reference.

Because many products sold through GlutenFree-Supermarket.com are food products, certain food items may not be eligible for return once shipped, delivered, opened, or otherwise handled, except where the product is defective, damaged, incorrect, unsafe, or applicable law provides otherwise.

Non-food merchandise may be subject to different return rules as described in our Refund Policy.

Our Refund Policy should be reviewed before making a purchase.

Nothing in these Terms or the Refund Policy eliminates any refund, replacement, warranty, or other remedy that applicable law requires us to provide.

9. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

Please inspect your order after delivery.

If you believe you received a product that is:

  • damaged;

  • defective;

  • incorrect;

  • materially different from what you ordered; or

  • compromised during shipment,

please contact us promptly.

We may reasonably request:

  • photographs;

  • package information;

  • lot or date information;

  • your order number; or

  • other information needed to evaluate the issue.

Depending on the circumstances and applicable law, the appropriate remedy may include replacement, refund, credit, or another reasonable resolution.

10. PROMOTIONS, DISCOUNTS, AND COUPONS

Promotions, coupons, discount codes, and special offers may be subject to separate terms.

Unless otherwise stated:

  • offers may not be combined;

  • offers may be limited to specified products or customers;

  • promotional quantities may be limited; and

  • promotions may be modified or discontinued before acceptance of an order.

We will honor promotions and discounts as required by applicable law and by the terms communicated with the applicable promotion.

11. GIFT CARDS AND GIFT CERTIFICATES

If we offer gift cards or gift certificates, they will be administered in accordance with applicable federal and state law.

Nothing in these Terms is intended to impose an expiration date, service fee, redemption restriction, or other limitation that would violate California law.

12. INTELLECTUAL PROPERTY

  • graphics;

  • videos;

  • page layouts;

  • designs; and

is owned by or licensed to Authentic GF Foods or its licensors.

You may use the Services for lawful personal and commercial purchasing purposes.

You may not, without prior written authorization:

  • reproduce substantial portions of the website;

  • commercially republish our proprietary content;

  • copy or exploit photographs, product descriptions, recipes, or graphics;

  • falsely suggest affiliation or endorsement;

  • use our trademarks in a misleading manner; or

  • infringe our intellectual property rights or those of another party.

Nothing in these Terms transfers ownership of intellectual property to you.

Authentic Foods, GlutenFree-Supermarket.com, and associated branding may be trademarks or trade names of Authentic GF Foods or their applicable owners.

Shopify trademarks and intellectual property belong to Shopify or its affiliates.

13. THIRD-PARTY SERVICES AND LINKS

The Services may integrate with or link to third-party:

  • websites;

  • applications;

  • payment services;

  • shipping providers;

  • analytics providers;

  • social networks; or

  • other services.

We do not control all third-party services and are not responsible for their independent acts, content, policies, or practices except to the extent liability may not lawfully be disclaimed.

Your use of a third-party service may be governed by that third party’s own terms and privacy policy.

14. RELATIONSHIP WITH SHOPIFY

GlutenFree-Supermarket.com is powered by Shopify.

However, products offered through GlutenFree-Supermarket.com are sold by Authentic GF Foods, not Shopify.

Purchases through GlutenFree-Supermarket.com are transactions between you and Authentic GF Foods.

Shopify provides technology and ecommerce services but is not the seller of the products unless expressly stated otherwise.

To the fullest extent permitted by applicable law, Shopify is not responsible for claims arising solely from products sold to you by Authentic GF Foods.

Nothing in this section limits rights that applicable law does not permit you to waive.

15. PRIVACY

Our collection, use, retention, disclosure, and other processing of personal information is governed by our Privacy Policy.

Our Privacy Policy is incorporated into these Terms by reference but is a separate document.

Because GlutenFree-Supermarket.com collects personal information such as customer names, shipping addresses, email addresses, telephone numbers, order information, and related information, our Privacy Policy describes our relevant privacy practices and the rights available to consumers.

Where applicable, we will provide notices or mechanisms required by California privacy law, including any legally required notice at collection, opt-out mechanism, or consumer-request process.

Nothing in these Terms is intended to waive or restrict privacy rights provided by applicable law.

16. REVIEWS, PHOTOGRAPHS, COMMENTS, AND OTHER USER CONTENT

If you voluntarily submit a review, comment, photograph, testimonial, recipe, suggestion, or other content (“User Content”), you represent that you have the right to submit that content.

You grant Authentic GF Foods a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, and use submitted User Content in connection with our business, products, website, and marketing, unless we agree otherwise.

You retain ownership of rights you otherwise hold in your User Content.

You may not submit content that:

  • infringes another person's intellectual property;

  • violates privacy or publicity rights;

  • is fraudulent or knowingly misleading;

  • contains malicious software;

  • is unlawful or defamatory; or

  • impersonates another person.

If a review or endorsement was submitted in connection with compensation, a discount, free product, or another incentive, legally required disclosures must be made.

17. WEBSITE ERRORS AND CORRECTIONS

The Services may occasionally contain:

  • typographical errors;

  • incorrect prices;

  • outdated information;

  • incorrect inventory information;

  • shipping errors; or

  • other inaccuracies.

We may correct such errors when discovered.

If an error materially affects an order already placed, we will provide an appropriate remedy, which may include contacting you for approval of a correction or canceling and refunding the affected item.

Nothing in this provision permits deceptive pricing or misleading advertising.

We may suspend or restrict access where reasonably necessary to protect customers, Authentic GF Foods, Shopify, third parties, or the integrity and security of the Services.

19. AUTOMATED ACCESS AND AGENTS

Automated access through bots, crawlers, scraping systems, artificial intelligence systems, or autonomous or semi-autonomous agents must comply with:

  • applicable law;

  • published technical restrictions;

  • robots directives;

  • security measures;

  • authentication requirements; and

  • other access controls we or our service providers implement.

Automated systems may not circumvent CAPTCHAs, rate limits, security controls, or measures designed to prevent or regulate automated access.

Where technically required, automated agents must accurately identify themselves and must not falsely represent themselves as human users.

20. DISCLAIMER REGARDING THE WEBSITE AND SERVICES

To the fullest extent permitted by applicable law, the website and online Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • the website will always be available;

  • access will always be uninterrupted;

  • every website feature will function without error; or

  • the website will be free from every security vulnerability.

This disclaimer applies primarily to the website and online Services and is not intended to eliminate or restrict statutory warranties, product-liability obligations, food-safety obligations, or consumer remedies that cannot legally be waived.

21. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUTHENTIC GF FOODS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF THE WEBSITE OR ONLINE SERVICES.

THIS LIMITATION DOES NOT APPLY TO THE EXTENT LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

WITHOUT LIMITATION, NOTHING IN THESE TERMS EXCLUDES OR LIMITS RIGHTS OR REMEDIES THAT CANNOT LEGALLY BE WAIVED, INCLUDING RIGHTS THAT MAY ARISE FROM:

  • PERSONAL INJURY;

  • DEFECTIVE OR UNSAFE PRODUCTS;

  • FRAUD;

  • WILLFUL MISCONDUCT;

  • VIOLATIONS OF APPLICABLE CONSUMER PROTECTION LAW; OR

  • OTHER NONWAIVABLE STATUTORY RIGHTS.

22. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Authentic GF Foods and its affiliates, officers, directors, employees, agents, and service providers harmless from third-party claims arising directly from:

  1. your unlawful use of the Services;

  2. your material breach of these Terms;

  3. your infringement of another person's rights; or

  4. unlawful content you submit through the Services.

You are not required to indemnify us for claims arising from our own negligence, wrongful conduct, violation of law, defective products, or other conduct for which applicable law does not permit indemnification.

23. CALIFORNIA CONSUMER RIGHTS

If you are a California consumer, you may have rights under California law that cannot be waived by contract.

Nothing in these Terms is intended to waive rights provided under applicable California consumer protection statutes or other nonwaivable law.

If any provision of these Terms conflicts with a nonwaivable right provided by applicable law, the applicable law will control.

24. GOVERNING LAW

Except to the extent another law must apply, these Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Nothing in these Terms deprives a consumer of protections that apply under mandatory law in the consumer's jurisdiction.

25. VENUE

Subject to applicable law, disputes may be brought in a court of competent jurisdiction in California.

Nothing in these Terms requires a consumer to bring a claim exclusively in Los Angeles County if applicable law provides the consumer with the right to bring the claim in another proper venue.

Nothing in this section modifies venue rights that cannot lawfully be waived.

26. NO WAIVER OF STATUTORY RIGHTS

No provision of these Terms will be interpreted to waive or limit a statutory consumer right if applicable law prohibits such a waiver.

If a purported waiver is prohibited or unenforceable, that provision will be enforced only to the maximum extent legally permitted.

27. SEVERABILITY

If any portion of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

An unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

28. ENTIRE AGREEMENT

These Terms, together with our:

  • Privacy Policy;

  • Refund Policy;

  • shipping disclosures;

  • applicable promotional terms; and

  • any additional terms expressly agreed to in connection with a particular transaction,

constitute the agreement governing use of the Services.

Nothing in these Terms overrides a specific written commitment expressly made by Authentic GF Foods regarding an individual order, customer, or transaction.

29. CHANGES TO THESE TERMS

We may update these Terms periodically.

The revised Terms will identify the applicable effective date.

Material changes will be communicated where required by applicable law.

Changes ordinarily apply prospectively and will not retroactively eliminate rights that accrued before the revised Terms became effective.
